SPECIFIC CLAUSES OF THE LEASE

1.1 The agreed price includes:

  • Value Added Tax (VAT), Corresponding Fees and Taxes.
  • Unlimited mileage.

  • The mandatory protections of the vehicle and the complementary civil liability for damages caused to third parties as a result of the use and circulation of the car, as well as the damages suffered by the vehicle provided by MILLER Car Hire.

  • The possibility of having two authorized drivers.
  • Full-full refueling policy.
  • Delivery and pick-up service at the airport.

 

1.2 They are not included in the price:

  • The additional cost of renting a child seat.
  • The delivery and pick-up service at locations other than the airport.

 

1.3 Relevant Information:

The required documentation includes the presentation of the passport or the National Identity Document (DNI), as well as a valid driving license according to Spanish regulations and a credit card in good condition during the reception of the vehicle if there are outstanding payments.

Any delay in the return of the car of more than 29 minutes from the end time of the contract will generate a surcharge of one extra day in concept of delay.

The reservation of a vehicle does not guarantee the availability of a specific model (make, model, color, equipment, etc.) but is related to a category of vehicles that share similar technical characteristics and habitable capacity.

In the event that the vehicle receives a fine during the term of this contract, the customer will be responsible for the total amount of the fine and will have to pay an additional charge of € 40 for the processing of penalties.

If the flight is redirected to another airport, it is the customer’s responsibility to arrive at the original airport and notify MILLER Car Hire of the situation.

MILLER Car Hire reserves the right to cancel the delivery of the vehicle if there are legitimate reasons to question the customer’s financial solvency or if the customer has a history of non-payments or serious incidents with MILLER Car Hire.

In case of damages or breakdowns caused by the negligence of the customer, MILLER Car Hire will not provide a replacement vehicle.

For special cleaning, if the customer returns the vehicle in an unusually dirty condition (vomit, garbage, sand, pet hair, etc.) or with an unpleasant smell (smoking is prohibited inside the vehicles), MILLER Car Hire will apply a charge ranging from € 50 to € 150.

Cancellation conditions for prepaid reservations: To request a refund of the prepaid amount, the customer must contact the entity with which he made the reservation and provide the details of his reservation to request the refund. To obtain a full refund, cancellation must be made a minimum of 48 hours in advance, or, in case of partial refunds, the customer must communicate at least 3 hours before the scheduled pick-up time. These specific conditions have priority over the general conditions.

 

General Terms and Conditions of the Rental

  1. OBJECT OF THE AGREEMENT

1.1 The lessee, who must be at least 25 years of age (leasing is not allowed to drivers under 25 years of age), receives for rent the vehicle detailed in the rental agreement, in an optimal and complete working condition with all its documents, tires, tools and accessories. He undertakes to keep them in good condition and to drive the vehicle in accordance with the rules of the Highway Code, as well as with the provisions established in these General Terms and Conditions.

  1. DURATION OF THE CONTRACT

2.1 The duration of the contract is specified in this document, which details the date and time of delivery and return of the vehicle. If the renter decides to terminate the contract early, the amount corresponding to the unused days of use of the vehicle, including taxes, will not be refunded.

  1. EXTENSION OF THE CONTRACT

3.1 The hirer is responsible for returning the vehicle on the date and time agreed in the previous section. If the renter wishes to extend the rental period, they must contact MILLER Car Hire to notify their interest and check availability. In case of extending the contract, the renter must make an additional payment for the extension through a payment link provided by MILLER Car Hire.

3.2 In the event that it is not possible to extend the contract due to the unavailability of vehicles or other reasons, the lessee must return the vehicle on the agreed date, branch and time.

  1. CONDITIONS OF RETURN OF THE VEHICLE

4.1 The renter will return the rental vehicle in the same condition as it was delivered to him, together with all its documents, tires, tools and accessories, at the place, date and time established in the rental agreement.

4.2 The renter may not alter any technical characteristics of the vehicle, keys, equipment, tools and/or accessories, or make any modifications to its exterior and/or interior appearance. Otherwise, the renter will be responsible for the expenses necessary to restore the vehicle to its original condition, without prejudice to the damages caused to MILLER Car Hire due to the immobilization of the vehicle during said process, as well as any other damage caused to MILLER Car Hire.

  1. CONSEQUENCES OF NON-RETURN OF THE VEHICLE

5.1 The return or abandonment of the vehicle at a place other than that specified in the contract grants MILLER Car Hire the right to:

  • Demand the payment of the rent corresponding to the additional days necessary to recover the vehicle and make it available for rental.
  • Impose a compensation of € 150 per day for the economic damages caused.

  • To make the lessee bear the costs of towing, tolls and storage, if any, up to the place agreed in the contract for the return of the vehicle.

5.2 MILLER Car Hire reserves the right to take appropriate legal action in case of disappearance or non-return of the vehicle, and the lessee assumes all responsibility for the legal consequences that may arise from this situation. The unilateral extension by the renter of the duration of the contract will be considered as an unauthorized use of the vehicle, with implications on the renter’s liability for any damage that the vehicle may present.

 

General Terms and Conditions of Payment

  1. PAYMENTS

1.1 The customer undertakes to make the following payments to MILLER Car Hire:

1.1.1 The costs of the rental of the vehicle, insurance and taxes determined according to the current rate of MILLER Car Hire, which has been previously communicated to the customer. The application of the initially agreed rate will be subject to the return of the vehicle being made at the specified place, date, time and condition. The rates may vary depending on the season and the location of the branches, so before renting a vehicle, the customer will be responsible for verifying the applicable rate.

1.1.2 Any other additional services requested by the customer, in accordance with the contractual and commercial conditions offered by MILLER Car Hire.

1.2 Payments arising from improper use by the customer:

1.2.1 The customer undertakes to pay MILLER Car Hire the following amounts after the end of the rental of the vehicle:

1.2.1.1 “Special cleaning” charge that covers the expenses related to an additional cleaning service due to the manifestly inadequate condition of the vehicle at the time of its return. This charge has a minimum amount of € 50 and a maximum of € 150.

1.2.1.2 The expenses caused by the loss of the vehicle keys and/or the shipment of a set of keys or crane.

1.2.1.3 The cost of moving the vehicle by means of a crane in case of puncture or burst tires and in situations of negligence on the part of the customer.

1.2.1.4 Expenses resulting from the loss, deterioration or damage to rims, tires (including punctures and blowouts), tools, accessories, vehicle interior, as well as problems caused by an error in the type of refueled fuel.

1.2.1.5 Tolls, fines, penalties and court costs arising from traffic violations or from laws, regulations or ordinances (including congestion charges or traffic restrictions where applicable) incurred by the customer during the duration of this Contract and which have been paid by MILLER Car Hire.

1.2.2 Notwithstanding the foregoing, MILLER Car Hire reserves the right to charge the customer an additional fee of €40 for the administrative costs incurred as a result of the formalities and communications with the relevant authorities related to such events.

1.2.3 The costs of repairing damage caused to the vehicle in the event of an accident, in the following circumstances:

1.2.3.1 The vehicle was not used in accordance with the established conditions.

1.2.3.2 The damages are the result of an accident caused by the customer’s failure to properly assess the height of the vehicle.

1.2.4 The amounts derived from these circumstances will be charged directly to the customer by MILLER Car Hire through a payment link or equivalent method used for the hiring of the vehicle.

1.3 In all cases, MILLER Car Hire will immediately inform the customer about the charge made and the reasons that motivated it, providing the customer with all available information.

1.4 The amount of the charge made to the customer for the damage caused to the vehicle will be calculated taking into account the assessment made by an expert external to MILLER Car Hire.

Likewise, MILLER Car Hire reserves the right to charge the customer compensation for the loss of profits due to the immobilization of the vehicle as a result of the damages suffered. This compensation will be calculated based on the number of days necessary to repair the vehicle, as determined by an expert external to MILLER Car Hire or, once the repair is completed, using a calculation basis of one day for every eight hours of work invested by the repair shop and a daily contracted occupancy rate will be added. The maximum liability of the customer will be limited to the market value of the vehicle.

 

  1. PAYMENT METHOD

2.1 The accepted payment methods are as follows:

2.1.1 Payment link: advance payment of the reservation before pick-up.

2.1.2 Credit card: VISA, Mastercard and American Express.All of them are credit only. At the time of collection of the vehicle the card must be in the name of the person listed as the holder of the rental contract. Upon collection of the vehicle, the presentation of a single credit card in the name of the holder of the rental contract will be required for the payment of the reservation.

 

Insurance and Coverages

  1. Conditions for the Validity of the MILLER Car Hire Coverage

1.1 The cover provided by MILLER Car Hire will be in effect as long as the following requirements are met:

1.1.1 The customer, in the event of being involved in a collision, must provide MILLER Car Hire, within a maximum period of forty-eight hours after the incident, with complete information about the other party involved and any available witnesses. This will be carried out by completing an accident report in the form of an “Amicable Declaration of Accident” (DAA). This report should include details such as the license plate, name and address of the other party involved, the circumstances of the accident, an outline of the accident, the name of the insurer and, where possible, the insurance policy number. Both parties involved in the accident must sign this report.

1.1.2 The insurance company must not reject the claim because the vehicle was not driven in accordance with the physical and psychological conditions required by the Highway Code.

1.1.3 The incident of collision, theft, fire or vandalism must not have occurred during the unauthorized use of the vehicle.

1.1.4 The customer must notify MILLER Car Hire of any collision, theft, fire or vandalism that occurred on the vehicle within forty-eight hours after the incident, and provide the relevant documentation (accident report, report to the authorities, etc.).

1.2 You are EXPRESSLY EXCLUDED from this coverage:

1.2.1 Damage to tires, rims and vehicle interiors in case of negligence on the part of the customer.

1.2.2 Punctures and tire blowouts in case of negligence on the part of the customer.

1.2.3 Damage caused to the clutch and gearbox due to the driver’s negligence.

1.2.4 Days of immobilization of the vehicle until its repair in case of negligence.

1.2.5 Crane expenses in case of negligence.

1.2.6 Recharging the battery in case of negligence on the part of the customer.

1.2.7 Errors in refueling and the resulting damage to the vehicle as a result of this.

 

  1. Obligations of the Customer in Case of Accident and Other Circumstances

2.1 In the event of an accident, the customer undertakes to:

2.1.1 Obtain and forward to MILLER Car Hire, within a maximum period of forty-eight hours after the incident, complete information about the other party involved and any available witnesses. This will be carried out by completing an accident report in the form of an “Amicable Declaration of Accident” (DAA). This report should include details such as the license plate, name and address of the other party involved, the circumstances of the accident, an outline of the accident, the name of the insurer and, where possible, the insurance policy number. Both parties involved in the accident must sign this report.

2.1.2 Immediately notify the authorities if the guilt of the other party should be investigated or if there are injured people.

2.1.3 Not to leave the rented vehicle without taking appropriate measures to protect it.

2.2 In case of vandalism, fire, theft or disappearance of the vehicle:

The customer undertakes to immediately inform MILLER Car Hire about the incident and file the corresponding complaint with the relevant authorities, providing a copy of said complaint to MILLER Car Hire as soon as possible.

 

  1. Unauthorized Use

3.1 It is the customer’s responsibility to use the vehicle with due diligence, according to its characteristics, respecting the current traffic rules and avoiding any situation that may cause damage to the vehicle or to third parties.

3.2 In addition, the customer must not allow any unauthorized person to drive the vehicle in accordance with the terms of this contract. The customer will be directly responsible for any damage caused to the vehicle or to third parties in case of non-compliance.

3.3 Any action that contravenes the provisions of these paragraphs will be considered as unauthorized use.

3.4 The customer shall be fully liable for damages caused to the interior and exterior parts of the vehicle as a result of unauthorized use of the same.

3.5 Unauthorized use includes, but is not limited to, the following cases, mentioned by way of example:

  • Pushing or towing another vehicle.
  • Driving in areas not suitable for public traffic, such as beaches, motorsports circuits, forest tracks, neighborhood roads, etc.

  • Driving on unpaved roads or in poor condition that may damage the lower part of the vehicle.

  • Driving in restricted areas, including airport runways and other areas associated with aviation and/or military use.

  • Not responding properly to the warning signs of the leased vehicle, such as warning lights or signals on the control panel.

  • Transporting goods or animals, especially dangerous, flammable and/or harmful substances for the vehicle and its occupants.
  • Transporting people or goods with a direct payment to the customer.

  • Sublease the vehicle.

  • Using the vehicle for illegal activities.

  • Transporting a number of people or amount of luggage that exceeds those authorized for the vehicle.

  • Manipulate or intervene in any way with the odometer of the vehicle, without delay to inform MILLER Car Hire about any malfunction of the same

 

Joint Responsibility for Contractual Obligations

1.1 All authorized customers and additional drivers will be held jointly and severally liable for all obligations arising from the contract and the legal provisions applicable to it.

Theft and Loss of Personal Items

2.1 MILLER Car Hire assumes no responsibility for objects stolen, lost or left inside the vehicle.

Approved Compulsory Restraint Device for Children

3.1 In the case of using the vehicle to transport children under three years of age or who do not exceed a height of 150 centimeters, the customer must notify MILLER Car Hire. Consequently, MILLER Car Hire will provide, upon payment of the corresponding rental fee, the appropriate approved mandatory restraint device according to the weight and height of the child or person requiring it. The installation of the device will be the sole responsibility of the customer.
